Court Reverses Order to Dismiss Pleas in Creek Marina Project Case

In a significant development, a division bench of the Sindh High Court has reversed a single bench’s order that dismissed the applications of Creek Marina Pvt Ltd, the firm responsible for constructing the Creek Marina project in Defence Housing Authority (DHA) Phase VIII ¹.

  • The project consists of eight high-rise residential towers.

Legal Proceedings

  • Creek Marina Pvt Ltd filed a lawsuit and applications seeking to restrain DHA from interfering with the construction activities or taking over the project.
  • A single bench of the Sindh High Court dismissed the applications, noting the plaintiff’s failure to complete the project despite ample opportunities.
  • The firm filed an intra-court appeal against the order, which was heard by a division bench comprising Justice Jawad Akbar Sarwana and Justice Mohammad Abdur Rahman.
  • The division bench has restrained PDOHA from interfering and disturbing the peaceful possession of the petitioner until the next date of hearing.
